What goes through the notaio

At the deed the notaio collects the purchase taxes and pays them to the State, and those are worked out here. The notaio’s own fee has no national tariff, so it is quoted rather than calculated.

The notaio’s own fee

  • There is no national tariff: it was abolished in 2012 (D.L. 1/2012 art. 9), so each notaio sets a price.
  • The notaio must tell you in writing, before starting, what the work involves and what it will cost. Ask for that quote before the preliminare.
  • Unless agreed otherwise, the buyer pays the costs of the deed (art. 1475 c.c.), and so usually chooses the notaio.
  • The fee carries IVA at 22%. A mortgage is a second deed, usually with the same notaio, with a fee of its own.
  • You can ask more than one notaio for a written quote and compare what each includes: the checks on the property, the registration and the taxes collected.

This is arithmetic over national rules, not advice. The notaio applies the tax and can confirm every line; the bank’s own PIES is what the mortgage costs.

What you hand the notaio at the deed

Part of what you pay the notaio is not the notaio’s fee: it is the purchase taxes, which the notaio collects and pays to the State when registering the deed. From a private seller those are the imposta di registro, ipotecaria and catastale; from a builder the three fixed taxes, while the IVA goes to the builder on its invoice.

Then there is the fee itself, for the deed, the checks on the property and the filings. There has been no national tariff since 2012 (D.L. 1/2012 art. 9), so no calculator can give you the figure: you ask for it.

How to ask for a quote and compare quotes

The notaio must tell you in writing, before starting, what the work involves and what it will cost. Ask for that quote before the preliminare, while you are not yet bound.

Compare what each quote includes: the visure ipotecarie and catastali, registration and transcription, the taxes collected, and IVA at 22% on the fee. If you take a mortgage, the mortgage is a second deed with a fee of its own.

Questions people ask

How much does the notaio cost for a prima casa?
The taxes the notaio collects can be worked out: on a prima casa bought from a private seller they start at €1.100. The fee has no national tariff and differs from one notaio to the next, so ask for a written quote.
Who chooses and who pays the notaio?
Unless agreed otherwise the buyer pays the costs of the deed (art. 1475 of the Italian civil code), and so usually chooses the notaio.
Can the notaio’s fees be deducted from income tax?
Not the fee for the purchase deed. The notaio’s fees for the mortgage contract on a prima casa count as costs of the mortgage, deductible at 19% together with the interest, up to €4.000 a year.
Is IVA paid to the notaio?
No. In a sale under IVA the IVA is paid to the builder, on its invoice. The notaio collects the three fixed taxes of €200.
