Terms of use

What Nesso does, what it deliberately does not do, and what each of us is answerable for. Using Nesso means agreeing to these terms.

1. Who you are contracting with

Nesso is operated by the person or company identified at the end of this page, whose details are published there as required by art. 7 of Legislative Decree 70/2003 on information society services.

These terms apply to the Nesso website, the web application and the native apps built from it. If you are a consumer, nothing in them takes away a right the Italian Consumer Code gives you, and where a term here and a mandatory rule disagree, the rule wins.

2. What Nesso is

Nesso is a record-keeping tool for somebody looking at a home. It gives you a list of things to check, takes readings your phone can take, holds published figures about the area and the market, and assembles all of it into a record you can read again later or hand to somebody else.

It is in beta and currently covers Torino. Parts of it are marked as not covered or not built, and those labels are accurate rather than modest.

Nesso holds no property listings, and has no relationship with any estate agent, agency or portal. It is paid by nobody for what it shows you.

3. What Nesso is not

This section is the most important one in this document. Nesso produces analysis from published sources and from what you record yourself. It does not give advice, and several kinds of advice are reserved by law to people who are authorised to give them.

Not investment advice
The Investment screens report figures published by the Agenzia delle Entrate and by public statistical bodies, normalised against ranges the app shows you. They are analysis of published data, not a personal recommendation, and they are not advice within the meaning of the Consolidated Law on Finance (Legislative Decree 58/1998) or MiFID II — which reserve investment advice in relation to financial instruments, and direct property is not one. Nesso is not authorised by Consob and does not carry out any reserved investment service.
Not a forecast
Where the app shows momentum, a yield or a change over time, it is stating what a published edition recorded, with the period and the publisher named. It is not a prediction of what a property will be worth or what it will earn. No figure in Nesso is a promise about the future, and the product is written so that it cannot phrase one.
Not estate agency or mediation
Nesso does not bring parties together, does not negotiate, and takes no commission from any transaction. It carries out no activity reserved to registered agents under Law 39/1989 and Legislative Decree 59/2010.
Not a survey, a valuation or a certificate
Nesso does not inspect a building and does not value one. It is not an energy performance certificate, a declaration of conformity for any installation, a structural assessment or a technical report, and it does not replace a surveyor, an engineer, an architect, a certified installer or a lawyer.
Not legal, tax or mortgage advice
Nothing in Nesso is advice on a contract, on tax, or on borrowing. Where it shows a rule — short-let regulation, for instance — it is describing a published source and telling you what it could not check.

4. Where the numbers come from, and what they are worth

Nesso shows two kinds of figure and keeps them apart on purpose. One kind is what somebody published, named with its publisher and its edition. The other is what you recorded yourself. Nesso adds nothing of its own to either.

Published data can be out of date, can cover a wider area than the one you are looking at, and can be wrong at source. Where Nesso knows a figure covers a whole district or province, it says so and refuses to paint it onto a smaller area. Where it holds nothing, it says not covered rather than filling the space.

Anything you paste from an advertisement is stored as a claim the advertisement made, never as a fact. We do not check advertisements and we do not stand behind what they say.

5. Your account

  • You must be at least 18 to have an account.
  • Give an e-mail address you control. It is how you get back in.
  • Keep your password to yourself. Anybody with it can read your record.
  • You can end a single signed-in browser, or all of them at once, from the account screen.
  • Resetting your password ends every signed-in browser, including the one that asked.
  • You can delete your account at any time. Read section 11 of the privacy notice first: it says exactly what deletion does and what it leaves behind.

6. What you record stays yours

The verdicts, notes, readings and priorities you enter are yours. We hold them so we can show them back to you, and for nothing else. We do not publish them, sell them, or show them to an agent, an agency or another user.

You give us only the permission needed to operate the service — to store what you record, to display it to you, and to compute a score from it while you are looking at it. That permission ends when you delete the record.

Do not record anything you have no right to record, and do not enter personal data about other people beyond what a property record actually needs.

7. How Nesso may be used

Use it to look at homes. Specifically, do not:

  • Extract our data in bulk, or copy a substantial part of the databases we have assembled.
  • Use automated tools against the service, or work around the limits that keep it available to everybody.
  • Use Nesso to make a request to a third-party website that you are not entitled to make.
  • Try to reach another user record, or any part of the system you have not been given.
  • Resell access, or present Nesso output as a professional valuation, survey or opinion.
  • Break any law, or use Nesso to discriminate against anybody in housing.

We may suspend or close an account that does any of these. Where we do, we will say why, and you can reply.

8. Data sources and their licences

Nesso is built on public data. These attributions are required by the licences those sources are published under, and they are part of these terms.

OpenStreetMap
Map geometry, amenities and street data are © OpenStreetMap contributors, available under the Open Database Licence (ODbL) 1.0. The map style and tiles are built from that data and carry the same licence.
Agenzia delle Entrate — Osservatorio del Mercato Immobiliare
Property quotations, transaction counts and market intensity figures are published by the Agenzia delle Entrate and used under its terms of use, with the edition named beside every figure.
ISTAT
Census and population figures are published by the Istituto nazionale di statistica under Creative Commons Attribution 3.0 Italy.
Comune di Torino
District boundaries and local statistics are published by the Comune di Torino as open data under its published licence.

Everything else — the check libraries, the wording, the scoring method, the interface — belongs to the operator of Nesso and is protected by copyright and by the database right. You may read it and use it for your own decision; you may not copy it into a product of your own.

9. Availability, and changes to the service

Nesso is provided as it stands, without any charge, and while it is in beta it may be interrupted, changed or withdrawn. We do not promise it will be available at any particular moment, and we do not promise a particular result from using it.

If we introduce a paid feature, we will say what it costs before you commit to it, and the Consumer Code rights that come with a distance contract — including the 14-day right of withdrawal — will apply and be described at that point.

We may change these terms. Where a change matters to you we will say so on this page before it takes effect, and by e-mail if you have an account. Continuing to use Nesso after that is acceptance; if you would rather not, you can delete your account.

10. What we are answerable for

We are answerable for our own wilful misconduct and gross negligence, and for anything Italian law does not permit us to exclude, including harm to a person. Art. 1229 of the Civil Code makes any clause to the contrary void, and there is no such clause here.

Beyond that, and to the extent Italian law allows, we are not answerable for a decision you take about a property, for a published figure that turns out to be wrong at source, for a defect in a building that no check in Nesso asked about, or for a loss that follows from any of those.

If you are a consumer, this section does not reduce the statutory rights the Consumer Code gives you, and any part of it that would be unfair under art. 33 of that Code does not apply to you.

11. Law, and where a dispute is decided

Italian law applies. If you live in another EU country, you also keep the protection of the mandatory rules of the country you live in.

If you are a consumer, a dispute is decided by the court where you live or are domiciled — art. 66-bis of the Consumer Code — and no term here moves it. If you are not a consumer, the court of the operator registered office has jurisdiction.

Before going to court you may use an out-of-court dispute resolution body under arts. 141 and following of the Consumer Code, or civil mediation under Legislative Decree 28/2010. Write to us first: most of this can be settled in an e-mail.
